Terms Of Service
Last updated 24 August 2026
These terms set out how VK Garden Works provides garden maintenance work and what you can expect from us, and us from you. They apply to every quote given and every job carried out unless something different has been agreed in writing.
1. Who we are
VK Garden Works is a garden maintenance business trading from Maidstone, Kent, providing lawn care, general garden maintenance, hedge cutting and planting to private and commercial customers across Kent and the surrounding area.
You can reach us on 07739 561645 or at email us. In these terms, "we" and "us" means VK Garden Works, and "you" means the customer.
2. Quotes and prices
- Quotes are given free of charge. Wherever possible we will arrange a free site visit before pricing, so that the quote is as accurate and honest as we can make it.
- A quote is based on the information and photos you give us, or on what was visible at a site visit. It stays open for 30 days unless we say otherwise.
- If the work turns out to be materially different to what was described or seen, for example significantly more growth, buried obstructions, restricted access or hidden waste, we will stop and agree a revised price with you before carrying on. We will not simply add charges afterwards.
- Prices for regular visits are agreed per visit. We will give you at least 30 days notice in writing before changing a regular visit price.
- Unless stated otherwise, quotes include removal of green waste generated by the work.
3. Booking and access
- A booking is confirmed once you accept the quote by phone, text, email or in writing.
- You are responsible for making sure we can get to the working area on the agreed day, including any gates, side access, keys or codes we have been told about.
- Please make sure pets, children, vehicles, garden furniture and anything fragile are kept clear of the working area.
- If we arrive as arranged and cannot access the site, or the site is not ready, we may charge a call out fee to cover the wasted visit.
4. Regular visits and scheduling
- Regular customers are given a slot which we aim to keep consistent through the season.
- Weather, ground conditions and daylight affect garden work. If a visit cannot safely or sensibly go ahead, we will move it to the next available day and let you know.
- Grass growth is seasonal. Visit frequency through winter is usually reduced by agreement.
5. Cancellation
- Please give us at least 48 hours notice if you need to cancel or move a booked visit.
- Cancellations inside 48 hours, or cancellation on the day, may be charged at up to the full visit price where we cannot fill the slot.
- Either of us can end a regular arrangement by giving 30 days notice. No reason needs to be given.
Your cancellation rights as a consumer
If you are a consumer and the contract was agreed away from our premises, for example over the phone, by email or at your home, you have a legal right to cancel within 14 days of agreeing it, without giving a reason, under the Consumer Contracts Regulations 2013.
If you ask us to start the work within that 14 day period and then cancel, you will need to pay for the work already carried out up to the point of cancellation. To cancel, just tell us by phone, text or email.
6. Payment
- Payment is due on completion of the work unless different terms have been agreed in writing.
- Commercial and contract customers may be invoiced on agreed terms, normally payable within 14 days of the invoice date.
- We accept bank transfer and cash.
- Late payment on commercial accounts may carry statutory interest and reasonable recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998.
7. The work itself
- We will carry out the work with reasonable care and skill, as required by the Consumer Rights Act 2015.
- Gardens are living things. We cannot guarantee that any plant, hedge or lawn will survive, establish or recover, because that depends on weather, soil, watering, pests, disease and aftercare beyond our control.
- Where we plant on your behalf, we will plant at correct spacing and depth and advise on aftercare, but ongoing watering and care is your responsibility.
- Hard landscaping, including block paving, driveways, decking, structural walls and drainage, is not offered.
- We do not carry out work on trees where a Tree Preservation Order, conservation area restriction or similar consent is required, unless you have obtained the necessary consent and provided evidence of it.
- It is your responsibility to confirm boundary ownership before we cut, reduce or remove any hedge or planting on a boundary line.
- We follow the Wildlife and Countryside Act 1981 in relation to nesting birds. Between roughly March and August we may have to postpone hedge work where an active nest is present. This is a legal duty and is not negotiable.
8. Green waste
Where waste removal is included, green waste generated by the work is removed and disposed of responsibly. We do not remove household rubbish, builders waste, soil, rubble or any hazardous material unless specifically agreed and quoted for.
9. Problems and complaints
If you are not happy with any part of the work, tell us within 7 days of the visit and we will come back and put it right where the issue is something we are responsible for. We would always rather fix it than argue about it.
Nothing in these terms removes or limits your statutory rights as a consumer.
10. Liability
- We take reasonable care on site, but we are not responsible for pre-existing defects, for example fence panels, walls, paving or pipework already in poor condition, or for underground services, cables and irrigation that we were not told about.
- We are not liable for loss or damage that was not foreseeable, or for business losses such as loss of profit, where you are using our services for commercial purposes.
- Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
11. Photographs
We sometimes photograph completed work for our own website and social media. Photographs never include house numbers, vehicle registrations or anything else that would identify a property or a person. If you would prefer we did not photograph your garden at all, just say so and we will not.
12. Data protection
How we handle your personal information is set out in our Privacy Policy.
13. Changes to these terms
We may update these terms from time to time. The version published on this page at the date your work is agreed is the version that applies to that work.
14. Governing law
These terms are governed by the law of England and Wales, and any dispute will be dealt with by the courts of England and Wales.
15. Contact
Questions about these terms can go to email us or 07739 561645.
